Terms of Service

1. Acceptance of Terms

By accessing or using TrueComply (“Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service.

If you are using TrueComply on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” and “your” refer to that entity.

2. Description of the Service

TrueComply is a SaaS tool that scans websites for accessibility issues based on the Web Content Accessibility Guidelines (WCAG) 2.1 AA standard. The Service provides automated scan reports, issue summaries, and (on paid plans) AI-generated code fix suggestions.

TrueComply is an assistive tool, not a certification service. Scan results are automated and may not capture every accessibility issue. You remain solely responsible for your website's compliance with all applicable laws and standards, including the Americans with Disabilities Act (ADA) and WCAG.

3. Eligibility and Account Registration

You must be at least 18 years old to use TrueComply. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@truecomply.io if you suspect unauthorized access.

4. Acceptable Use Policy

You may only use TrueComply on websites you own or have explicit written authorization to scan. The following are prohibited:

• Scanning websites you do not own or have authorization to test.
• Bypassing or abusing rate limits, scan quotas, or usage controls.
• Using the Service to perform denial-of-service attacks or place excessive load on any server.
• Reselling or sublicensing access to the Service without our written permission.
• Reverse-engineering or decompiling TrueComply's platform.
• Using the Service to facilitate any activity that violates applicable laws.

We reserve the right to suspend or terminate accounts that violate this policy, without refund.

5. Subscription Plans and Billing

TrueComply offers three subscription tiers:

• Free: No charge. Includes 1 site, 1 scan/month, up to 5 pages per scan, and a full WCAG 2.1 AA violations report.
• Pro ($29/month): 1 site, up to 10 scans/month, up to 25 pages per scan, AI-generated code fixes, and email notifications.
• Agency ($99/month): Unlimited sites and scans, up to 100 pages per scan, AI fixes, white-label PDF reports, API access, and priority support.

All paid subscriptions are billed monthly in advance via Stripe. Prices are in USD and exclude applicable taxes. We will give at least 30 days' notice of any price increase.

6. Cancellation and Refunds

You may cancel your paid subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for partial months.

Refund requests should be sent to legal@truecomply.io within 14 days of the charge. Refunds are issued only for billing errors or significant service failures.

7. Service Availability

We aim to keep TrueComply available, but we do not guarantee uninterrupted or error-free access. We do not offer a formal SLA for uptime. Temporary interruptions do not entitle you to a refund or credit unless they exceed 72 consecutive hours and are caused by our infrastructure.

Scan accuracy depends on the crawlability of the target site. Some pages may not be detected due to authentication, bot protection, or dynamic rendering.

8. Intellectual Property

Our platform: TrueComply's technology, design, software, scan algorithms, and AI models are owned by us and protected by intellectual property law. These Terms grant no rights to our IP beyond a limited license to use the Service.

Your scan results: Reports generated from your submitted URLs are yours. We do not claim ownership over your website's accessibility data.

Aggregate data: We may use anonymized, aggregated usage data to improve TrueComply. This data does not identify you or your website individually.

Feedback: Any feedback or suggestions you provide grant us a royalty-free, perpetual license to use them without restriction or compensation.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that TrueComply will identify every accessibility issue, that acting on results will make your site legally compliant with the ADA or WCAG, or that the Service will be free from errors or interruptions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUECOMPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless TrueComply and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) scanning any website without proper authorization; or (d) any claim that your use infringes a third-party right.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

Informal resolution: Before filing any claim, contact us at legal@truecomply.io and allow 30 days for informal resolution.

Arbitration: Unresolved disputes shall be settled by binding individual arbitration under AAA Consumer Arbitration Rules. Each party bears its own costs unless the arbitrator decides otherwise.

Class action waiver: All claims must be brought on an individual basis. Neither party may bring class or representative actions.

13. Termination

We may suspend or terminate your access at any time if we believe you have violated these Terms. Sections 8–12 survive any termination or expiration of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or site notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
